VIGO COUNTY, Ind. (WTWO/WAWV) — The Court of Appeals of Indiana have affirmed the decision by a Vigo County court not to hear a defendant who is charged with murder in the death of Chloe Carrol that had asked for the charges to be dismissed.
According to Vigo County Prosecutor Terry Modesitt, the motion was made following the juvenile court waiving jurisdiction, and charges being filed in adult court against the the now 17-year-old. When a Vigo County judge denied that motion, the defense filed an appeal.
Citing recent Indiana Supreme Court rulings, the court affirmed Vigo County Judge Michael Lewis’ denial of Ellington’s motion to dismiss.
“We continue to seek justice in this case for everyone that was in the car that night, including the family of Chloe Carroll.” Prosecutor Terry Modesitt said. “I would like to thank Attorney General Todd Rokita and Deputy Attorney General Ellen Meilaender for the work their team put into this appeal process so this case can continue to move forward.”
Modesitt ended his release by reminding everyone that while Ellington is charged, the charges are merely accusations, and Ellington is presumed innocent unless proven guilty beyond a reasonable doubt in court.
Ellington remains held in custody by the Indiana Department of Corrections.
