TERRE HAUTE, Ind. (WTWO/WAWV) — A Terre Haute man is facing extra felony charges after an attempt to serve a warrant turned into a fight with police.
The tussle included police delivering a headbutt and knee strike, and ended with the man in handcuffs and leg shackles before being placed in a police cruiser and taken to the Vigo County Jail.
That’s according to the Terre Haute Police Department, who wrote about the incident in a probable cause affidavit filed in Vigo County Court. The PCA details the arrest of 28-year-old Kyle Mulkins of Terre Haute on March 7.
According to the document, a US Marshal spotted Mulkins in a vehicle and knew he had a warrant for his arrest. The officer followed the vehicle until it stopped at a vape shop in town and Mulkins went inside.
“When the male exited the car he was positively identified as Kyle Mulkins, before going back into the vape shop,” the PCA reads. “Due to Mulkins’ history of violence and resisting, several other officers were also contacted to assist. Once all officers were in the area, they surrounded the building.”
Police reported that Mulkins immediately began resisting arrest when officers tried to handcuff him.
Kempf overserved [Mulkins] reaching for his waist area and called out what [Mulkins] was doing with his hands. Unable to get his right hand away from his waist, Pearce head butted (sic) [Mulkins] in the chin, which stunned him and allowed Pearce to move his hand away from his waist
Probable Cause Affidavit filed in Vigo County Court
As the tussle continued Mulkins was reported to have told officers “I’m going to beat your f****** a**.”
Police noted using a knee strike to get Mulkins to the ground where they had to apply leg shackles to prevent Mulkins from kicking officers. Police also said Mulkins attempted to headbutt an officer while being placed in a patrol vehicle.
“It should be noted that several people who claimed to be family members came out and attempted to interfere with the arrest,” THPD Sgt. JT Pearce wrote.
As a result of the incident, Mulkins has been charged with the following;
- Kyle Mulkins, 28, of Terre Haute
- Battery with bodily injury to a public safety officer (x2)
- A level 5 felony
- Intimidation
- A level 6 felony
- Resisting law enforcement – defendant causes bodily injury (x2)
- A level 6 felony
- Resisting law enforcement
- A class A misdemeanor
- Battery with bodily injury to a public safety officer (x2)
Court records also show that Mulkins faces the following charges in unrelated cases currently open in Vigo County:
- Escape
- A level 6 felony
- Resisting law enforcement using a vehicle
- A level 6 felony
- Criminal recklessness with a deadly weapon
- A level 6 felony
According to jail officials, Mulkins is currently in custody since his March 7 arrest. Officials said Mulkins’ bond amount is set at a total of 35,000 with no 10% allowed.
Court records show Mulkins will next be in court for a pre-trial hearing at 8:30 a.m. on May 28.
