MARTINSVILLE, Ind. — A former substitute teacher for Martinsville Schools is in jail after she allegedly had sex with at least one, and as many as 10 students, according to court documents.
Brittany Fortinberry, 31, was charged with the following:
- Three counts of Sexual Misconduct with a Minor, a Level 4 Felony
- Dissemeniation of Matter Harmful to a Minor
- Contributing to the Delinquency of a Minor

Fortinberry is currently being investigated for an alleged attack on two students in August of 2024 at Eminence High School.
According to court documents, on Dec. 10, 2024, a grandmother went to authorities to disclose that Fortinberry had allegedly sexually attacked her then 15-year-old grandson. The next day, the officer interviewed the grandmother who claimed that the boy was molested by Fortinberry, after she sent him nude pictures.
The grandmother also claims that Fortinberry gave the minor drugs, per the court documents. She further alleged that Fortinberry told the boy that if they told someone she would kill herself.
The detective later spoke with the minor who claimed that the suspect added him on Snapchat. The male minor alleged that Fortinberry molested him multiple times, took him on an out-of-town trip, and took showers together. The student estimates that at least five and as many as 10 children have been victimized by her attacks.
In the minor’s statements with the officer, the minor corroborated claims found in an earlier investigation which alleged that she had a stripper pole in her home, along with a myriad of sex toys and drugs.
Fortinberry was hired as a substitute for Martinsville Schools on Oct. 24, 2023 and resigned on Jan. 9, 2024.
