TERRE HAUTE, Ind. (WTWO/WAWV) — A Terre Haute man reportedly told police he had sexual misconduct with a minor on her birthday in order to “make her feel special” before his arrest.
That’s according to court documents filed in the case against 30-year-old Donald Mallery Jr. Police reportedly began investigating the situation on June 3 after the Department of Child Services filed a report.
A probable cause affidavit said that Mallery admitted to police during an interview in explicit language to having touched, kissed, and had other sexual relations with a 15-year-old.
“Donald explained that on December 29th, 2022 it was [victim’s] birthday and that he ‘wanted to make her feel special’.”

Jail records indicate that Mallery was arrested on July 17. In a probable cause hearing, Judge Matthew Sheehan found cause for the warrantless arrest and gave prosecutors 72-hours to file formal charges.
The affidavit calls for Mallery to be charged with three counts of sexual misconduct with a minor, two being level four felonies with the third being a level five felony. As part of the hearing, Judge Sheehan set Mallery’s bond at $75,000 with no 10% allowed.
Mallery is scheduled for an initial hearing regarding this matter at 11 a.m. on July 21.
