VIGO COUNTY, Ind. (WTWO/WAWV) — A Terre Haute man will spend years behind bars after pleading guilty to having sexual contact with a 15-year-old girl.
Donald Mallery Jr. appeared in Vigo County Superior Court 5 on Wednesday for a change of plea hearing. Judge Matthew Sheehan accepted Mallery’s guilty plea for the level 4 felony charge of sexual misconduct with a minor. The charges stem from the events of December 29, 2022. In an interview with investigating police Mallery explained his motivation.
“Donald explained that on December 29th, 2022 it was [victim’s] birthday and that he ‘wanted to make her feel special.’”

As part of the deal, a level 5 felony charge of sexual misconduct with a minor was dismissed. Judge Sheehan then moved immediately to sentencing Mallery.
Mallery was given eight years, with five of those executed to be served in prison and three years listed as formal probation. According to jail records, Mallery has been held in custody since his July 17, 2023 arrest and will receive credit for time served.
